CLARIFICATION ON NEW CELL PHONE REGULATION

The Federal Motor Carrier Safety Administration has ruled that commercial vehicle drivers, licensed to carry 10,000 pounds or more, are now prohibited from holding or dialing a mobile phone while operating their vehicles during interstate commerce.
This ruling does not apply to intrastate traffic.  In other words if a CDL driver is driving/hauling in Missouri only, either on state highways or the interstate, this new ruling does not apply.  However if his/her route will cross the Missouri state line at any portion of the trip, he/she is restricted from holding or dialing a hand held mobile device.

The only time a commercial driver may use the mobile/cell phone during interstate commerce is when the vehicle is stopped in a parking area or to the side of the road.  However, the driver may use a hand held mobile device in emergencies to notify law enforcement.

Mark sure all your commercial drivers are aware of the new law before they take off in their vehicles.  The fines cover both drivers and companies for whom the drivers work.  Those penalties range upwards of $2,750 for drivers to $11,000 for companies per occurrence.
